Particular Terms and Conditions of Sale for excursions

These Particular Terms and Conditions of Sale (hereinafter the “Car Excursion PTC”) supplement the General Terms and Conditions of Sale applicable to the type of Client (B2C GTC, B2B Agencies GTC or B2B Corporate GTC, depending on the Client). They apply to accompanied tourist excursions carried out on board a vehicle made available with a driver-guide by the Seller.
The excursion is a tourism and leisure service; it is in no way of a sporting nature. In the event of contradiction, the order of priority defined in the GTC applies.

Article 1. Definition of the service

The Seller makes available to the Participants a vehicle with a driver-guide in order to carry out a predefined excursion (visits to estates, tastings, discovery of the vineyard and heritage). The content, indicative itinerary, duration and services included are described in the quotation, the travel booklet or by e-mail.
Article 2. Meeting point, times and delay
The meeting point and departure time are confirmed to the Client in writing. Each Participant arrives at least 10 minutes before the departure time. Any delay may result in the cancellation of the excursion for the Participant concerned, without refund or compensation, and without a Participant’s delay giving rise to any extension of the duration of the service.

Article 3. Vehicle, driver, capacity and luggage

The vehicle is suited to the number of Participants indicated in the quotation and complies with the regulations in force. The number of Participants may not exceed the capacity of the vehicle. The volume of luggage and effects carried is limited to the capacity of the vehicle; the Seller may refuse any luggage compromising safety. The driver-guide is solely responsible for driving and safety on board.

Article 4. Conduct and adaptation of the itinerary

The driver-guide decides on the pace, breaks and itinerary, which they adapt according to traffic conditions, weather, site opening times and the interest of the Participants. They may change the route if the safety or interest of the Participants so requires. The order of visits may be changed without the overall content of the excursion being altered.

Article 5. Tastings and consumption of alcohol

The excursion may include tastings of wines, cognacs and other spirits. Each Participant who chooses to take part undertakes to consume in moderation. The service of alcohol to a minor is prohibited. As the driver-guide is driving, the Participants are not responsible for driving during the excursion.

Article 6. Safety on board

Each Participant complies with the safety instructions, wears the seatbelt and follows the instructions of the driver-guide. A child is transported by means of an approved and suitable restraint device; the Client reports the presence of children at the time of booking so that the vehicle is equipped accordingly.

Article 7. Conduct, refusal and exclusion

The Seller may refuse access to the vehicle or interrupt the excursion for any Participant whose behaviour compromises the safety or smooth running of the service, or who is under the influence of alcohol or narcotics, without refund or compensation. If a Participant is unable to continue the excursion, their transfer may be arranged by any means, the cost being borne by the Client.

Article 8. Weather conditions

As the excursion is carried out by vehicle, it is in principle maintained in all weathers. The Seller may nevertheless cancel or modify it in the event of an alert from the authorities or where the safety of the Participants so requires. In the event of cancellation by the Seller, the latter refunds the Client the full amount paid for the cancelled service, without further compensation.

Article 9. Liability and insurance

The Seller has taken out professional liability insurance. Its liability cannot be engaged in the event of non-performance due to force majeure, the act of a third party unconnected with the service or a Participant’s failure to comply with the safety instructions. The Participants are responsible for the safekeeping of their personal effects; the Seller is not liable for their loss, theft or deterioration. The Client is invited to ensure that the Participants have individual civil liability insurance.
