2. Intellectual property

This entire Site is governed by French law, in particular with regard to intellectual property and personal data, as well as by international law.

SARL THF holds the exclusive rights to use the word mark COGNAC TASTING TOUR, registered with the INPI (French Industrial Property Office) under number 3907526 since 23 March 2012.

The information, pictograms, icons, photographs, images, texts, video sequences, whether animated and with or without sound, and other elements appearing on the Site are protected by industrial and/or intellectual property rights of which SARL THF is either the holder or authorised to reproduce and represent them.

Accordingly, any reproduction, representation, adaptation, translation and/or modification, in whole or in part, or any transfer by any means whatsoever, and any extraction from the database by any means whatsoever, are prohibited without the express, prior and written authorisation of SARL THF. Any such act would constitute an infringement within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code and would expose the offender to legal proceedings.

Copying onto paper for private use of these various protected items is authorised in accordance with Article L.122-5 of the French Intellectual Property Code.

3. Personal data protection

Respect for the protection of personal data is a decisive element of the relationship of trust we wish to establish with you. The processing described below is carried out in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and French Act No. 78-17 of 6 January 1978, as amended, on information technology, data files and civil liberties.

  • to offer you our products and services or to introduce you to those of our partners;

We only carry out data processing where one of the following conditions is met:

  • your consent to the processing operations has been obtained;
  • our legitimate interest, or that of a third party, justifies carrying out the processing concerned;
  • the performance of a contract binding us to you requires that we carry out the processing concerned;
  • we are bound by legal and regulatory obligations that require the processing concerned to be carried out.

Where we seek your consent, it is collected directly on the form provided for the collection of the information concerning you. Your data is retained for the period strictly necessary for the purposes pursued, plus, where applicable, the applicable statutory limitation periods.

4. How to exercise your rights

You may exercise your rights (access, rectification, erasure, restriction, objection, portability) by contacting SARL THF:

Your request to exercise your rights must be accompanied by a copy of a signed identity document so that we can verify your identity.

You may lodge a complaint with a supervisory authority. In France, this is the CNIL, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07.

You may issue directives concerning the retention, erasure and communication of your personal data after your death, with a certified trusted third party responsible for ensuring that your wishes are respected, in accordance with the applicable legal framework.

5. Consumer mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, a consumer who has been unable to obtain satisfaction from SARL THF, after a prior written complaint, may refer the matter free of charge to the competent consumer ombudsman for the tourism and travel sector:

The ombudsman is referred to directly online via its website. The ombudsman may only be referred to after a prior written approach to SARL THF and within one year of that complaint.

6. Limitation of liability

SARL THF cannot be held liable for any material errors that may have crept into the documents on the Site, despite all the care taken in their publication.

The information provided on the Site is given for guidance only and does not exempt the user from a further, personalised analysis.

Nor can SARL THF be held liable for the information, statements and opinions expressed on the sites to which it points via hypertext links and over which it has no editorial control. Sites that choose to link to the Site are liable if they harm its image. Nor can SARL THF be held liable for the faulty transmission of data due to the various Internet networks, or for incompatibilities due to the user’s browser.

7. Governing law and jurisdiction

Any dispute relating to the use of the Site is subject to French law. Failing an amicable settlement, jurisdiction is granted to the courts within the jurisdiction of the Court of Appeal of Poitiers, subject, for consumers, to the provisions of Article R.631-3 of the French Consumer Code allowing them to bring the matter before the court of the place where they resided at the time the contract was concluded or the harmful event occurred.

8. Prevailing language

These legal notices are also published in French. This English version is a translation provided for information purposes only. In the event of any difference in interpretation, ambiguity or contradiction between the two versions, the French version shall prevail and is the only legally binding version.
